Choice of Law This Agreement shall be construed in accordance with the laws of the the City of Vallejo, Solano County, California, in the United States of America, without regard to its conflict of laws rules. You expressly agree that any claim or action arising out of or relating to these Terms of Service, Privacy Policy or Contest Rules or your use of the Site shall be filed only in the courts of the Solano County, California, USA, if applicable, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.

This ‘Terms of Service’, ‘Privacy Policy’ and ‘Contest Rules’ constitute the entire agreement between Western Dovetail, Inc. and you with respect to the Site and supersedes all prior or contemporaneous communications and proposals between us with respect to the Site. If any provision of these Terms of Service, Privacy Policy or Contest Rules is determined to be invalid or unenforceable, all other provisions shall remain in full force and effect. Without limitation, Western Dovetail, Inc. shall have the right, with or without notice and for any reason whatsoever, to immediately terminate your access to all or part of this Site in the event of any conduct by you which we, in our sole discretion, consider to be unacceptable, or in the event of any breach by you of any of these Terms of Service, Privacy Policy or Contest Rules.

Western Dovetail, Inc. Contest Rules

As a participant in a contest (“the Participant”) sponsored by or associated with Western Dovetail, Inc. through its websites and/or this Site, you agree by entering the contest and by using the Site to be bound by all terms, conditions and notices contained or referenced in the Contest Rules herein.

1. The Participant agrees to be bound by any and all specific geographic, time, date and other limitations imposed on the contest by Western Dovetail, Inc. in its sole discretion and having provided notice.

2. All prizes must be accepted by the winner as awarded. Prizes are non-exchangeable, non-transferable, and are not redeemable for cash or other prizes. Western Dovetail, Inc. retains the right to substitute a prize with another in the event the original prize offered is not available due to circumstances beyond Western Dovetail, Inc.’s control.

3. All prizes will be presented to winners at Western Dovetail, Inc. unless otherwise noted, Prizes may be shipped at the winner’s expense to be determined at the time of winning.

4. Inability of winners to accept the prizes will result in forfeiture. Certain prizes may require winner to be 18 years of age or older, or have signed permission of parent or legal guardian to accept the prize.

5. Western Dovetail, Inc. is not responsible for the disconnection of a participant’s telephone call due to local or long distance Phone Company’s failure, power company failure or act of God.

6. Employees of Western Dovetail, Inc., its affiliated companies, their advertising agencies and immediate families are not eligible to enter or win contests.

7. Winners must use their true, legal name when playing contests or claiming prizes and may not win any contest under an assumed name. Winner will be disqualified and prize(s) forfeited if they are found playing under an assumed name or alias.

8. Only one person may enter their name on any contest written entry form or Internet-based entry. No “duos”, groups or teams will be allowed to enter together.

9. If ticketed events have been awarded as a prize and the concert or event is postponed, rained out, cancelled, or does not occur for any reasons beyond the control of Western Dovetail, Inc., Western Dovetail, Inc. will not be responsible for replacing the prize.

10. Upon winning any prize from Western Dovetail, Inc., the contestant is no longer eligible to win any subsequent prize from Western Dovetail, Inc. for a period of thirty (30) days from the first win.

11. Upon winning a prize valued at $1,000 or more or winning a trip, no member of the household where the winner resides may win a subsequent trip or prize valued at $1,000 or more for a period of one (1) year from the first win.

12. The Participant agrees, in the event of winning the contest, to sign a release and indemnification agreement as a condition of receiving the prize, wherein the Participant agrees that he/she has entered the contest at their own risk and agrees to indemnify and hold forever harmless Western Dovetail, Inc., its affiliated and parent companies, its staff, sponsors, promotional agencies, agents, assigns or any of their staff responsible for injuries, accidents, misfortunes or causes of action arising from or in connection with the Participant’s participation in the contest and/or acceptance and use of the prize.

13. Winner will permit Western Dovetail, Inc. to use their name, voice and/or likeness without prior notice or compensation for promotional purposes in connection with the contest in mediums of all forms including television or radio broadcast, web cast, Internet or print.

14. No prize may be used in any way that might have or be expected to have an adverse or negative effect on Western Dovetail, Inc., including its business, reputation or employees.

15. Any and all disputes, conflicts, interpretations, questions or concerns regarding rules, contests and/or their associated prizes will be determined by Western Dovetail, Inc. in its sole discretion and whose decisions are final

16. The contest and prize are subject to Local, State and Federal regulations and laws and may be void where restricted or prohibited by law.

17. Western Dovetail, Inc. reserves the right to amend these contest rules and regulations at any time within its discretion and for any reason.
